KOCHI: The Kerala High Court Division Bench has put a stay on the order by the Single Bench to transfer the case with regards to the murder of Youth Congress leader Shuhaib to the CBI.

The Division Bench headed by justice Antony Dominic ordered for a stay while considering the appeal filed by the government against the judgement of the Single Bench.

The argument on this case will be heard on March 23.

The Single Bench judge justice Kemal Pasha ordered to transfer the case to the CBI based on the petition filed by Shuhaib’s father C P Muhammad, and mother S P Raziya.

S P Shuhaib was brutally hacked to death by a gang of men on the night of February 12.

The government had earlier informed the court that 11 of the accused in connection with the murder of Shuhaib were arrested within a period of three weeks since the incident, and also the murder weapon and the vehicle used by the accused to escape were also recovered. The Division Bench approved the argument by the government that the Single Bench ordered to transfer the case to the CBI without considering this progress in the investigation.

The court also agreed to the argument by the government that they were not given time to file a counter affidavit. The case was postponed following this for a detailed hearing.

The Division Bench might also hear the argument on the stance by the government that the judgement and remarks by the Single Bench would bring down the self-confidence and morale of the police.
