THIRUVANANTHAPURAM: A magistrate court here has admitted on record a petition that former Chief Secretary Nalini Netto had tampered with a key government file relating to the fireworks display accident that claimed the lives of over 100 spectators at the Puttingal temple in Kollam last year.

The magistrate has ordered the complainant, Gopakumar, to appear before him on September 27 to have his statement recorded.

Gopakumar has pleaded that Netto, currently Special Secretary to the Chief Minister, be prosecuted on the charges of forgery and cheating.

H.P. Sabu, counsel for Gopakumar, said the complaint related to a file that was opened by Netto in the aftermath of the tragedy.

On a particular page of the file, Netto, as Additional Chief Secretary, Home, had recommended departmental action against the City Police Commissioner, Kollam; Assistant Commissioner, Chathannur; and Circle Inspector, Paravur, on the charge of having failed to prevent the accident despite several cautionary reports.

The file was referred to the then Home Minister Ramesh Chennithala, who wrote that the file be viewed by the then Chief Minister Oommen Chandy and the then State Police Chief (SPC) T P Senkumar.

Chandy subsequently forwarded the file to Mr. Senkumar, who opined that the district administration, the licensing authority for the fireworks display, should also be held accountable along with the police authorities.

He included his suggestions as a one-page note to the file, which was returned to the Chief Minister’s office within the hour.

The complainant alleged at court that a tampered version of the file sans the views of Senkumar resurfaced when the newly elected Left Democratic Front government headed by Pinarayi Vijayan assumed office in May. He deposed that the “falsified” file was used as a ground to remove Senkumar as SPC. However, no action was taken against any other officer.

The complainant submitted in court a copy of the letter written by Chandy to  Vijayan stating that the file with his signature had been tampered with.
