KOCHI: The Division-Bench of the Kerala High Court has severely criticised Transpot Minister Thomas Chandy, who has submitted a petition with the court seeking to reject the report submitted by the Allapuzha collector that is against the minister.

“How can a cabinet minister appeal against the government?” asked the Bench.

The court that asked to clarify the validity of such an appeal, said that it’d consider the other things after they get an explanation on the same.

“A minister cannot appeal against the government. Only an individual can do so. But the petition submitted by Thomas Chandy clearly states in the first line itself that he’s appealing as a minister,” said the court, and added: “Even if the government had to appeal, it should have moved through the chief secretary.”

The court that said that the appeal of a minister against the government doesn’t have locus standi, also said that such an instance is probably a first of its kind in history.

Meanwhile, Thomas Chandy’s counsel Vivek Tankha argued that the minister has approached court as an individual, and added that the appeal by the minister is not against the government. He explained that the land that was wet filled belonged to Bhairavan and Ashalatha, and the collector’s finding that this land was handed over to Thomas Chandy is not true. Tankha also said that the land doesn’t belong to the minister.

However the court pointed out that it’s Thomas Chandy who owns the Water WorldTourism Pvt. Ltd. that runs the Lake Palace resort.

The court also criticised the revenue department. The court asked why the revenue department ordered a probe on the issue of backwater encroachment.
