KOCHI: The government has washed their hands off Transport Minister Thomas Chandy following the severe criticism of the minister with regards to the backwater encroachment issue.

The state attorney who appeared in court on behalf of the government has said that Thomas Chandy approaching the court against the report by the Alappuzha district collector was inappropriate. Earlier, the government took a favourable stand to wards Thomas Chandy but following the severe criticism of the minister by the Division-Bench of the HC, the government took a U-turn.

The court has said that the action by the minister was a serious mistake and deserves to be made ineligible. The HC pointed out that approaching the court against the collector’s report was akin to challenging the Constitution of India.

The court further said that if the minister was innocent of the allegations levelled against him, he must first prove it in front of the collector who made the report against him. “Instead of that, how can a minister in the cabinet appeal against the government’s decision?” asked the court.

The court which expressed its surprise at the government not opposing the petition by the minister, asked whether Thomas Chandy doesn’t have faith in the Chief Minister and the cabinet.

“Minister Thomas Chandy is behaving as if he has lost his sense of responsibility. How is the minister able to raise arguments against the Constitution? Did you approach the court with a petition thinking that you can befriend the court and maintain your ministership?”

The court also said that a cabinet minister questioning the decision by the cabinet which he is a part of is proof enough to show that the government has lost collective responsibility.

“How can Thomas Chandy continue working with the other ministers in the cabinet after all this?” asked the HC.
